Regarding litigation, Ryan focuses primarily on complex corporate-related claims and maintains a significant presence in the federal court system. He regularly practices before the Northern and Southern Districts of Indiana, in addition to the 7th Circuit Court of Appeals. Within this context, Ryan focuses on the sub-areas of financial, health care, and insurance-related litigation. As to financial institutions, Ryan has litigated TILA (Reg Z), RESPA (Reg X) including the post Dodd Frank Act amendments, ECOA, FDCPA, FCRA, FACTA, including other Reverse Mortgage related policy issues. In addition to addressing these issues at the district and circuit level, Ryan has argued these matters through adversary-proceedings in U.S. bankruptcy courts. As to health care entities, Ryan has litigated general health care related matters as well represented health care entities and their management and executive level health care personalities. Here, Ryan focuses on the general bodies of law and agencies that influence the health care industry. Additionally, he maintains a small, but deep involvement in the area of insurance litigation as a stand-alone practice area, as well as a sub-category of his financial and health care practice areas. More generally, Ryan has litigated multi-party, multi-circuit disputes in the federal forum, achieving offensive and defensive resolution of matters on dispositive motions, including class action claims, and trial and appellate success. Lastly, Ryan has litigated many state and federal agency issues and maintains a working knowledge of agency rules within these industries.
Regarding Ryan’s transactional and corporate practice, he regularly acts as a legal business partner to general corporations. He maintains a broad skillset that includes health care contracting, mergers, acquisitions, general corporate guidance, and compliance experience. Within his corporate practice, Ryan focuses heavily on the health care industry. He maintains working knowledge of the laws that affect these institutions within the context of these transactions—HIPPA, Stark, Anti-Kickback Statute, False Claims Act, Civil Monetary Penalty Law, State and Federal licensing dispute. Having litigated these matters, as well as negotiated them in a business context, Ryan’s transactional and corporate practice maintains a goal of achieving a client’s intents on the transaction while building long-term, strategic partnerships within the industry. All of this is done while minimizing legal exposure for novel structuring models. Additionally, on behalf of his clients, Ryan regularly works with the state and federal agencies which regulate these matters.
